Competent Person Under Factories Act 1948
A prime requisite to pass through internal, external, and third party inspections and audits in factories and industries is to get your machinery tested and certified periodically by a competent person under factories ACT 1948. A comprehensive check and test of the plant machinery by a competent person, and getting them certified regularly and periodically is most important and crucial part of compliance all through India. This is governed by the Indian Factory Act 1948.

When to do Testing of Equipment
Testing Frequency to be followed Under Factory Act 1948
Section 31:
This section is for air compressors, air receivers, safety valves, pressure vessels etc. For air compressors, air receivers, air dryers, safety valves, pressure vessels etc. 6 (six) monthly testing should be done through visual inspection and thickness checking. Pressure valves must bechecked by repeat blow offs at set pressures. After every 2 (two) years, these equipment must be tested hydraulically. Pressure valves must be checked for pressure setting and calibration every 2 years.
Section 29
All lifting tools and tackles, forklifts, belts, chain pulley blocks etc are tested under this section. This equipment is tested every 6 months through visual inspection, safety check and load tests.
Section 28
Lifts, EOT cranes and hoists come under this category. They are tested for 6 monthly visual inspections, safety checks and load tests.
Section 21(2)
This section deals with dangerous machinery and fencing and covering of dangerous operations including prime moving parts and flywheels. These machines are tested every 6 months, and are passed through safety check and load tests.
How Equipment Testing is done under Factory Act 1948
- A site visit is planned for the work by discussing a convenient date and time for this with the customer.
- On visiting the site, all the machines are checked, inspected for damage and vital details.
- Thickness testing, pressure testing, hydraulic testing etc are done as per frequency and requirement.
- All the tested machines are tagged with proper stickers which show their date of testing, next due date, and equipment identification number.
- Certificates for the testing done are issued and delivered to the customer in hard copy.
- On request soft copies of certificates are also given.

Our Competent person, being approved and licensed by the govt. of Himachal Pradesh has the authority to perform tests all over Himachal Pradesh and also in the Union Territories of India. Hence, if an industry belongs to any of the following areas in India, then we can perform the tests there as per the Factory Act 1948.
